To Buyers

Purchase Price

The Buyer shall pay the hammer price together with a premium at the stated rates of 16% on the hammer price. VAT on the premium is charged according to regulations operated by HM Customs & Excise.

Inspection

Each Buyer has an opportunity to inspect the goods in the auction sale before making a bid and this acknowledges that he is satisfied with the physical condition and description of the lot (including whether the lot is damaged or has been restored/repaired).

Property and Risk

Each lot is at the sole risk of the Buyer following the fall of the hammer. The Auctioneer shall not be responsible if the goods are lost, stolen, damaged or destroyed. The legal title in a lot shall not pass to the Buyer until the lot(s) has been paid for in full.

Removal of Goods

The Buyer will obtain a receipt of payment for goods bought at Auction which, when presented, allows removal of goods. If goods are not removed and paid for within 14 days the Auctioneers reserve the right to charge a storage / warehousing fee. The goods remain the responsibility of the Buyer from the fall of the hammer and any liability for the loss or damage of goods shall remain at the risk of the Buyer until removed. Small items may be removed after payment during the course of the sale. Large items shall not be claimed or removed until the sale has been concluded.

Payment

The Buyer may pay by cash, debit card or credit card. (There is a 2.5% surcharge on all transactions made by credit card.)

Bidding

The highest bidder shall be the buyer except in the case of a dispute. Any disputed lot may be re-offered for sale at the absolute discretion of the Auctioneer. Each lot is put up for sale subject to any reserve price placed by the Seller. The Auctioneer may bid on behalf of the seller for all goods which are being offered subject to reserve.

Every Bidder

Shall be deemed to act as principal or acts as an agent on behalf of a named principal. A Registration form must be completed by the Buyer before the sale when a Bidding Number will be given.

Commission to Bid

Perry & Phillips will execute bids on behalf of intending buyers unable to attend the sale at no charge. The Auctioneer undertakes to purchase lots as cheaply as allowed by other bids and reserves. In order to secure an item Perry & Phillips may go one bid above the commission if an under-bidder reaches the commission price. Bids must be submitted in writing and whilst every care is taken in carrying out instructions Perry & Phillips cannot be held responsible for errors or omissions made in carrying out such bids.

General

Perry & Phillips do not accept responsibility for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any lot unless they have been instructed in writing by the seller to so certify and in such case the auctioneers act as agents of the seller and are not themselves responsible for such claims.

Delivery

Arrangements can be made for delivery of items for an additional fee. Buyers requesting goods to be sent to an address by mail or courier, will be charged a fee for Postage, Packing and Insurance if necessary.

To Sellers

Terms Of Business

The seller authorises Perry & Phillips to deduct Commission at the published rate – 16% of hammer price – high value items by negotiation. Insurance is charged on all lots at a premium of 1% of hammer price. There is a minimum commission charge of £4 per item. VAT applies at the current rate according to HM Customs & Excise.

Unsold Lots

A charge of £4 per item applies plus VAT at the current rate. This covers administration costs.

Reserves

All items will be sold without reserve unless notified on the Receipt Form or otherwise in writing. Perry & Phillips will be pleased to advise on suitable protective reserves prior to the sale.

Transport

Perry & Phillips can arrange collection of items with their own transport – goods covered by insurance premium. Goods delivered by a third party are not insured until they are accepted at Perry & Phillips’ premises.

Receipt Of Goods

All goods delivered to Perry & Phillips’ premises will be deemed to be for sale by auction unless otherwise stated in writing to be sold at Perry & Phillips discretion, accepted by them and subject to all sale conditions. Instructions given by telephone are accepted at the seller’s risk and must be confirmed in writing.

Recission

Perry & Phillips acts as an agent for the seller and does not claim any responsibility on behalf of themselves or the seller for any mis-descriptions concerning lots. In accordance with the requirements of the Terms and Conditions of Sale, Perry & Phillips will rescind the sale of any item which is considered (in the light of further evidence) to be a deliberate forgery or misrepresentation. The seller agrees to be bound by Perry & Phillips decision.

Indemnity

The seller shall indemnify Perry & Phillips against any claims in connection with any goods sold on the seller’s behalf.

Default

Perry & Phillips are not responsible for default by either the buyer or the seller because they act as Agents for the seller only. Therefore, no payment is made to the seller until payment is received from the buyer.

Loss Or Damage

Unless caused by the negligence of their employees, Perry & Phillips disclaim all responsibility for loss or damage, or for unauthorised removal of goods.

Storage Of Goods

Perry & Phillips reserve the right to store goods delivered to them for sale, either on their own premises or elsewhere. They reserve the right to make a charge for storage and any other associated costs. A similar warehousing charge will be applicable for goods left on their premises if vendor fails to remove them. They also reserve the right to dispose of any items not legally saleable (or considered to be unsaleable) and to charge for the removal and disposal of such items.

Insurance

All goods on Perry & Phillips premises and in their custody will be held insured against Fire, Theft and Accidental Damage for which Perry and Phillips will levy a premium. The basis of the cover will be the hammer price, less commissions and deductions for sold lots or in the case of unsold lots, the reserve price, or in the case of no reserve fixed, the lower end of Perry & Phillips’ estimate.

Payment To The Seller

Will be made 30 days after the date of the Auction subject to full payment being made by the Buyer(s). The Seller waives any rights to any interest that may have been earned during the period from payment by the Buyer to despatch of sale proceeds to the buyer.

Valuation Days

We hold free Valuation Days every Wednesday from 10 am to 4 pm. Items can be accepted on other weekdays by appointment. Any items brought to our salesroom will be valued for auction purposes free of charge. Receipts will be issued and reserve prices fixed at this stage. Alternatively, a Valuer can inspect your property at home or in store by appointment.
